HOUSING LAW

Pursuant to the Constitution of the Socialist Republic of Vietnam; 

The National Assembly enacts the Housing Law.

Chapter I

GENERAL PROVISIONS

Article 1. Scope of Application

This Law regulates the ownership, development, operation management, use of housing, transactions related to housing, and state management of housing in Vietnam, except as provided for in Clause 2 of this Article.

Transactions involving the sale, lease-purchase, and lease of commercial residential properties by enterprises, cooperatives, and cooperative unions engaged in real estate business, as well as transactions involving the transfer of residential property purchase contracts, shall be conducted in accordance with the provisions of the law on real estate business.

Article 2. Definition of terms

In this Law, the following terms shall have the following meanings:

Housing is a building constructed for the purpose of living and serving the daily needs of families and individuals. Housing is used for residential purposes and for non-residential purposes that are not prohibited by law, which constitutes mixed-use housing.

Detached housing refers to housing constructed on a separate plot of land under the right of use of an organization or individual, or on leased or borrowed land from an organization or individual, including villas, attached houses, and detached houses, built for residential purposes or mixed-use purposes.

An apartment building is a residential building with two or more floors, multiple apartments, shared hallways and staircases, private ownership areas, common ownership areas, and shared infrastructure systems for families, individuals, and organizations, including apartment buildings constructed for residential purposes and apartment buildings constructed for mixed-use purposes.

Commercial housing refers to housing that is invested in and constructed for sale, lease-purchase, or rental under market mechanisms.

Government housing is housing used to accommodate individuals who are eligible to live in government-rented housing while holding office or performing duties in accordance with the provisions of this Law.

Resettlement housing refers to housing allocated to individuals eligible for resettlement when the State reclaims land or demolishes housing in accordance with the law.

Social housing is housing supported by the State for individuals eligible for housing support policies under the provisions of this Law.

Worker dormitories in industrial zones are construction projects built on commercial and service land within the scope of industrial zones in accordance with the law on industrial zone management to accommodate workers who rent them during their employment in that industrial zone as stipulated by this Law.
