What is industrial design?
Industrial design is external shape of a product or component for assembly into a complex product — represented by shapes, lines, colors, or a combination of these elements, and must be visible when using the product. This is an object of industrial property and can be registered to obtain an exclusive protection certificate.
How is industrial design different from/similar to a trademark?
- Similarities: Both are industrial property and can be registered for protection in Vietnam.
- Differences:
- Industrial design protection external shape of the product (objective: aesthetics, design).
- Brand protection name, logo, text, images, slogan used to distinguish the origin of goods/services (purpose: brand recognition).

Industrial design registration file
An industrial design registration application file typically includes:
- Registration form (latest model: model No. 07, Appendix I to Decree No. 65/2023/NĐ-CP).
- Design description (brief, clear description stating the name, field of use, design features, and proposed scope of protection).
- Photograph or drawing Show the design (quantity, required angles — usually includes illustrations/images showing all angles).
- Documentation proving the right to file an application (e.g., power of attorney if submitted through a representative).
- Fee payment receipts
- Other documents (if priority is requested: proof of the first filing date in another country).
Note: Decree 65/2023/NĐ-CP has specified the form and presentation of the application; please use the official form to avoid requests for amendments.
Industrial design registration process
Preliminary search
- Perform searches on databases to determine the degree of duplication with designs that have been filed or published.
- Purpose: Preliminary assessment about novelty and distinctiveness of the design. If there are any duplicates, the design must be adjusted before submitting the application to avoid rejection during the content review stage.
Prepare documents and conduct preliminary checks
- Prepare the application form according to the template, prepare the description and photos/drawings.
- Check whether the design meets the conditions for protection (novelty, inventive step, industrial applicability) and whether it falls within the excluded category (e.g., mandatory product shape due to technical function).
Submit the application to the Intellectual Property Office (IPO)
Submit directly, by mail, or online via the Intellectual Property Office's Public Service Portal.
Formality review
The Bureau shall examine the completeness and formal validity of the application. If the application is valid, the Bureau shall issue Decision to accept valid applications.
Announcement of application
The application was published in the Industrial Property Gazette.
Content review
The office evaluates whether the design meets the protection criteria; there may be exchanges or requests for the applicant to provide explanations.
Issuance of Protection Certificates (Certificates)
- If accepted, the Bureau will issue Notice of Intended Grant of Patent.
- The applicant submits Fee for issuing a certificate within the specified time limit (usually one month).
- After paying the fee, the Bureau will issue Decision to Grant a Certificate of Protection and recorded in the National Registry.
Maintain validity Certificate
The owner exercises the rights. The validity of the industrial design certificate is 5 years and may be renewed consecutively 02 times, every five years (maximum total 15 years).

- Application fee: ~ 150,000 VND.
- Sorting fee (if applicable): ~ 100,000 VND per sort.
- Content review fee: ~ 700,000 VND per item.
- Publication fee: ~ 120,000 VND (second image onwards: ~60,000 VND/image).
- Search fee for appraisal (if required): ~ 480,000 VND per subject.
- Priority claim examination fee (if applicable): ~ 600,000 VND per priority claim.

Processing time & protection period
Processing time according to key milestones
- Form assessment: ~01 month from the date of submission (valid application).
- Publication of the application: ~2 months from the date of the valid decision.
- Content review: not more than 07 months from the date of filing the application.
Term of protection
- Industrial design patents are effective from the date of issuance. This effect lasts for five years from the date of filing.
- It can be extended a maximum of two times, each time for five years. The total maximum is 15 years from the date of application (pay the extension fee as prescribed when due).
