400;\"> is the trademark owner <\/span><b>legal transfer of ownership<\/b><span style=\"font-weight: 400;\"> for their trademark to other organizations or individuals through <\/span><b>assignment agreement<\/b><span style=\"font-weight: 400;\"> (Articles 148 and 149 of the Intellectual Property Law).<\/span><\/p>\n<h3><b>Who has the right to transfer a trademark?<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Only the following entities may carry out transfers:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Trademark owner<\/b><span style=\"font-weight: 400;\"> has been granted a Certificate of Protection;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Trademark applicant<\/b><span style=\"font-weight: 400;\"> (in the case of transferring a registration application before the certificate is issued).<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Note: With the application, the transferee only truly becomes the \u201cnew applicant\u201d when <\/span><b>The Intellectual Property Office records the change<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h3><b>Conditions for trademark assignment<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">The transfer agreement is only accepted when the trademark meets the conditions under the law:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Brand <\/span><b>still under protection<\/b><span style=\"font-weight: 400;\">, not suspended\/notified of termination;<\/span><\/li>\n<li 2026<\/a><\/strong><\/em><\/p>\n<h2><b>WHAT DOES A TRADEMARK ASSIGNMENT REGISTRATION FILE INCLUDE?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The documents specified in Article 150 of the Intellectual Property Law and the guidelines of the Intellectual Property Office include:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Trademark assignment agreement registration form<\/b><span style=\"font-weight: 400;\"> (Form 01 \u2013 Appendix A of the Intellectual Property Office);<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Trademark assignment agreement<\/b><span style=\"font-weight: 400;\"> (original or certified copy);<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Original Trademark Registration REGISTERING A TRADEMARK TRANSFER<\/b><\/h2>\n<h3><b>Step 1: Check the legal status of the trademark<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">FundGo Law regularly reviews the following validity;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Commitment and dispute resolution.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: Prepare the application according to the template and submit it to the Intellectual Property Office.<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Submit your application in one of the following ways:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In person at the Intellectual Property Office or at one of its two representative offices;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">By mail;<\/span><\/li>\n<\/ul>\n<h3><b>Step 4: Monitor the assessment<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Review period as prescribed: <\/span><b>approximately 2 months<\/b><span style=\"font-weight: 400;\"> from the date the Agency receives the valid application.
